DATA PROTECTION

Certain personal data of Investors (including, but not limited to, the name, address and committed/invested amount of each Investor) may be collected, recorded, stored, adapted, transferred or otherwise processed and used by the Company, the Custodian, the Administrative Agent, the Registrar and Transfer Agent, the Domiciliary and Corporate Agent and any other person who provides services to the Company from time to time and the financial intermediaries of such Investors.

In particular, such data may be processed for the purposes of anti-money laundering and terrorist financing identification, maintaining the register of Shareholders, processing subscription and redemption orders and payments of dividends to Investors and to provide client-related services. Such information shall not be passed on to any unauthorised third persons. 




The Company may sub-contract to another entity (the “Processor”) (such as the Administrative Agent and the Registrar and Transfer Agent) the processing of personal data. The Company undertakes not to transfer personal data to any third parties other than the Processor except if required by law or on the basis of a prior consent of the Investors.

Each Investor has a right of access to his/her/its personal data and may ask for a rectification thereof in case where such data is inaccurate or incomplete.  

It is however clearly specified that the data, collected as specified above, and held by the Company’s storage facilities, will not be shared with any other party than the Company, Compartment, or entity related to the Company, notwithstanding any demand from any third party whatsoever.  

By subscribing to the VOLTNOTES of the Compartment, each Investor consents to such processing of its personal data.

Money Laundering Prevention and Fight against Terrorist Financing

In order to contribute to the fight against money laundering and terrorist financing, the Company and Compartment will at all times comply with any obligations imposed by any applicable laws, rules, regulations and circulars with respect to the prevention of money laundering and terrorist financing obliging Investors to prove their identity to the Company and Compartment. Subscriptions will be considered valid and acceptable by the Company and Compartment only if the subscription form is sent together with: 

- in the case of natural persons, a copy of an identification document (passport or identity card), or 

- in the case of corporate entities, a copy of the corporate documents (articles of incorporation and a recent extract from the trade register, authorised signatures list, list of shareholders holding directly or indirectly more than 25% of the share capital or the voting rights of the investor, directors’ list, …) and a copy of the identification documents (passport or identity card) of the beneficiaries and of the persons authorised to give instructions to the Registrar and Transfer Agent. 

Such documents must be duly certified by a public authority (public notary, police, consulate, embassy) of the country of residence. 

The Company and Compartment, represented by its General Management Partner, remains ultimately responsible for the identification of all VOLTNOTES holders in accordance with prevailing legislation in Luxembourg concerning anti-money laundering and terrorist financing. 

In relation to an application for, or transfer of, VOLTNOTES, the Company may require at any time such documentation as it may deem appropriate and/or undertake additional investigations in accordance with national and international rules in force concerning anti-money laundering and terrorist financing. Failure to provide such information may result in an application not being processed.

Use our Services, we may collect and store information about you to process your requests and automatically complete forms for future transactions, including (but not limited to) your phone number, address, email, billing information and credit or payment card information. Correspond with VOLTNOTE for customer support;
Participate in the interactive services offered by the Platform such as discussion boards, competitions,promotions or surveys, other social media functions or make payments etc., or Enable features that require platform access to your address book or calendar; Report problems
for troubleshooting.
